General Terms and Conditions of Use

These general terms and conditions of use (hereinafter "the GTU") are agreed upon between the company TRAIL  located at 12 avenue Matignon 75008 Paris (hereinafter "TRAIL " or "we") and wealth management advisors, employees of private banks, and informed investors (hereinafter collectively "the Users") browsing the website trailcapital.eu operated by TRAIL (hereinafter "the Site").

TRAIL  and the Users will hereinafter be collectively referred to as "the Parties."

The cancellation of a clause of the GTU will not affect the validity of the GTU as a whole.

1. PURPOSE OF THE GTU

The purpose of the GTU is to define the conditions of use of the Site by the Users and to govern the relationships between TRAIL SOLUTIONS PATRIMOINE and the Users.

Consequently, any User wishing to use the Site, visit its various pages, and benefit from its content (as defined below) must first read and accept the GTU in their entirety.

We recommend that Users stop browsing our Site in case of disagreement with the latter.

In any event, access to and browsing of the Site or any part of the Site constitutes the User's full and unreserved acceptance of these GTU.

The fact that one of the Parties does not avail itself at any given time of one of the provisions of these GTU cannot be interpreted as a waiver of the right to avail itself thereof subsequently.

The cancellation of a clause of these GTU will not affect the validity of the GTU as a whole.

2. CONNECTION TO THE SITE / NAVIGATION

To use the Site, the User connects to the following URL address: https://www.trailcapital.eu

Access to the Site and its various pages is not subject to the creation of a user account.

3. PRESENTATION OF THE SITE

The purpose of the Site is to present to the Users:

  1. The positioning of TRAIL funds
  2. The current and past investments of TRAIL funds
  3. The teams and advisors in charge of the fund

A section of the Site is dedicated to answering questions that Users and (future) investors may frequently ask.

The Site offers, on a dedicated page, various news related to the companies in which TRAIL's funds have invested.

In any event, the Site does not offer Users the possibility to subscribe directly online to the services presented on the Site.

4. CONTENT OF THE SITE

4.a - The Website

The Site may contain confidential information as well as data protected by intellectual property rights.
Unless otherwise stated, the intellectual property rights on the web pages and on any data of any kind contained in the Site and each of the elements composing the Site (images, illustrations, sounds, texts, graphic elements, etc.), including software, databases, and newsletters (hereinafter the "Content") are the exclusive property of TRAIL.

The latter grants no license, nor any right other than that of consulting the Site.

Reproduction of all or part of the Content is only authorized for the exclusive purposes of information for personal and private use.
Any other reproduction or use is expressly prohibited.

It is also prohibited to:

TRAIL SOLUTIONS PATRIMOINE is the sole owner of the TRAIL and SLAM trademarks, their logos, and the domain name trailcapital.eu.

Users acknowledge the exclusive rights of TRAIL and undertake not to infringe upon them.

All other trademarks or logos on the Site belong either to TRAIL, or to its group, service providers, partners, or suppliers.

Any use requires express authorization.

4.c - Hypertext Links

TRAIL reserves the right to request removal of any unauthorized or prejudicial link to its Site.

4.d - Collection Forms

Users may send information requests by filling out the contact forms.

They guarantee the accuracy of the data submitted.

These requests are transmitted to TRAIL'scommercial department and processed as soon as possible.

5. SITE MANAGEMENT

TRAIL endeavors to ensure access to the Site 24/7. However, continuous access is not guaranteed.

TRAIL may:

  • Suspend or limit access
  • Reserve access to certain user categories
  • Delete disruptive or illegal content
  • Suspend the Site for maintenance or updates

6. LIABILITY RELATED TO THE USE OF THE SITE

Users are responsible for their equipment and internet access.
They acknowledge risks such as misappropriation or virus infections.

TRAIL is not responsible for malfunctions due to such causes.

Fraudulent access or disruption to an information system is punishable by law.

6.b - Limitation of Liability

TRAIL ensures accuracy and updates on the Site but does not guarantee completeness or third-party non-alteration.

It cannot be held liable for decisions or uses made from Site content, or for damages to Users’ technical environments.

The Site may contain links to external websites.
TRAIL is not liable for their accuracy, content, or consequences of their use.

7. PROTECTION OF PERSONAL DATA

TRAIL collects personal data in accordance with applicable regulations and its [Privacy Policy].

This Policy complements the GTU.

9. APPLICABLE LAW / LANGUAGE

These GTU are subject to French law.
The applicable language is French.

10. DISPUTE RESOLUTION

In case of disputes:

  • Users must first contact TRAIL (Article 11) for amicable resolution.
  • Failing that, disputes will be submitted:
    • For professional Users: to the Commercial Court of TRAIL’s registered office
    • For other Users: to the competent courts
